All services provided by MyGreenEcoHosting.com (“MyGreenEcoHosting.com”) may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless MyGreenEcoHosting.com from any claims resulting from the use of service which damages the subscriber or any other party.
Prohibited are sites that promote any illegal activity or present content that may be damaging to MyGreenEcoHosting.com’ servers, or any other server on the Internet. Links to such materials are also prohibited.
Examples of unacceptable content or links:
- Pirated software
- Hacker programs or archives
- Wares sites
NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND A $50.00 CANCELLATION FEE WILL APPLY. ADDITIONALLY, MyGreenEcoHosting.com WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.
TRAFFIC USAGE
Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward MyGreenEcoHosting.com, but also because it can overload MyGreenEcoHosting.com’ network and disrupt service to MyGreenEcoHosting.com’ subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, MyGreenEcoHosting.com will investigate and shutdown the account that is SPAMing. A $250 charge for violating this policy will be charged to the person initiating the SPAM. Furthermore MyGreenEcoHosting.com reserves the right to prosecute for this violation. A $1.00 charge will be assessed PER EMAIL sent should MyGreenEcoHosting.com choose to pursue and prosecute.
OBSCENE SPEECH OR MATERIALS:
Using MyGreenEcoHosting.com’ network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. MyGreenEcoHosting.com is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.
IRC
Using MyGreenEcoHosting.com’ network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.
SERVER ABUSE
Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
REFUSAL OF SERVICE
Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual’s system (often known as “hacking”). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).
BILLING
By the Account Activation Date of each month, MyGreenEcoHosting.com shall either:
(1) debit the client’s credit card (when such information has been provided by the client); or (2) deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to MyGreenEcoHosting.com by no later than the specified payment due date. MyGreenEcoHosting.com shall be entitled to immediately terminate this agreement for client’s failure to make timely payments. You will be provided with an invoice on a monthly basis. All credit cards are billed automatically on a monthly basis. It is the client’s responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send an e-mail notification, at which point we will need to be provided with another credit card account number within 24 hours. If we do not receive a response within 24 hours, the account, and all accounts under that acc ount plan, will be suspended.
SERVICE FEES
Certain services carry a setup fee charged by MyGreenEcoHosting.com to client, which must be paid by client in order to have use of said services. If client terminates this agreement, client shall be responsible for any and all outstanding fees owed to MyGreenEcoHosting.com and agrees to pay any and all fees incurred by client. Because the services are provided on a monthly basis, the client will be responsible for service fees incurred each month, regardless of when client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded.
MONEY BACK GUARANTEE & REFUND POLICY
Their is a monthly billing option for each plan in order to avoid having customers pay upfront for services not rendered and allows them to also try our services before entering into multi-year terms simply notify us and we will cancel your account prior to the next billing cycle. If however you have a multi year term with us anytime you know longer wish to use MyGreenEcoHosting.com for your webhosting needs simply send us an email at clientservices@mygreenecohosting.com and your account will be deactived prior to the following months invoice.
ACCOUNT DEACTIVATIONS
Any account deactivated due to non-payment will require a reactivation fee of $5.00 prior to reactivation.
CANCELLATION & REFUNDS
MyGreenEcoHosting.com does not refund partial monthly fees to accounts. We require 30 days notice for a cancellation. In addition refunds are not available for additional services which you may purchase at MyGreenEcoHosting.com for instance an additional domain name we may purchase for a client is not refundable and a dedicated IP which we may setup for a client for a charge is not refundable.
Web site files are the responsibility of the MyGreenEcoHosting.com customer and should a MyGreenEcoHosting.com customer decide to cancel their service it is the customer’s responsibility to make sure that they have backed up & downloaded the web site files and any emails from the MyGreenEcoHosting.com server prior to requesting that MyGreenEcoHosting.com cancels their account. Once the cancelation request has been submitted to MyGreenEcoHosting.com a cancelattion of the web site hosting service may occur anytime after the request is received by MyGreenEcoHosting.com and when a cancelation request is completed the client’s hosting account with MyGreenEcoHosting.com and their web site files are permenantly removed from the MyGreenEcoHosting.com servers. Therefore again it is the client’s obligation to ensure that they have downloaded their web site files and any emails from the server prior to their cancelation request.

LIMITATION OF LIABILITY
MyGreenEcoHosting.com shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from MyGreenEcoHosting.com ‘ servers going off-line or being unavailable for any reason whatsoever. Furthermore, MyGreenEcoHosting.com shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of MyGreenEcoHosting.com ‘ servers. All damages shall be limited to the immediate termination of service.
VIOLATIONS
Violations of these Acceptable Use Policies should be referred to policies@mygreenecohosting.com. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.
DISCLAIMER
MyGreenEcoHosting.com cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by MyGreenEcoHosting.com are resold. Thus, certain equipment, routing, software and programming used by MyGreenEcoHosting.com are not directly owned or written by MyGreenEcoHosting.com. Moreover, MyGreenEcoHosting.com holds no responsibility for the use of our clients’ accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as MyGreenEcoHosting.com sees fit.
If a customer’s hosting account is found to have violated the client content, excessive resource user policy and/or is storing files for archiving purposes, the contents will be removed and while we make best effort to contact customers before hand, can occur without notice.

We do not set limits on the disk space and bandwidth (data transfer) that we provide in plans that are marked “Unlimited”. We want you to have the resources available to you to build a great online presence.

EXCESSIVE RESOURCE USER POLICY:
Resources are defined as disk space, bandwidth, and/or computing resources (cpu, memory, disk i/o) utilization. MyGreenEcoHosting.com offers a shared hosting service in which environment customers may share resources with other customers, therefore it is imperative that MyGreenEcoHosting.com control any excessive usage by customers so that they do not disrupt the service quality of other customers using the same resources. A hosting account is considered using “Excessive amounts of resources” when it consumes 100% of 1 CPU core, and/or 512 MB Memory and/or 20 concurrent connections also known as “Computing Resources”, and/or “Resources”, and/or “Resource Usage”. There are numerous issues that could cause such problems, including but not limited to: cgi scripts, FTP, HTTP, etc. To prevent service disruption for other customers, a hosting account which exceeds the included computing resources will be slowed down automatically for as long as the resources are being overused. MyGreenEcoHosting.com will make every reasonable effort to notify customer prior to suspension, however, MyGreenEcoHosting.com may suspend any offending hosting account prior to notifying the customer of the account in the event that service disruption to other customers was/is caused. The customer whom is using “excessive resources” may be asked to upgrade his/her package to a more suitable hosting package, such as but not limited to a premium account, virtual private server or dedicated server. MyGreenEcoHosting.com will be the sole and final arbitrator as to what constitutes as a violation of this policy. Customers have access to their Resource Usage within their control panel.
NO “SPAM”:
UCE/UBE or “Spam” originating from a server located on our network or associated with a Green Geeks server is not tolerated. This includes any e-mail that promotes web sites hosted on a server located on the MyGreenEcoHosting.com network but is sent from an e-mail address not associated with that MyGreenEcoHosting.com account. Client shall not use their MyGreenEcoHosting.com services for chain letters, junk mail, bulk-email, or any use of distribution lists to any person who has not given specific permission to be included in such a process. MyGreenEcoHosting.com reserves the right to deactivate or terminate any account(s) upon any indication of such activity without notice.
EXCESSIVE EXPLOITS
MyGreenEcoHosting.com allows 3rd party scripts to be uploaded/installed from our auto-installer or manually (those scripts that are/aren’t included in the auto-installer) on your web hosting account. It is the responsibility of our web hosting clients to maintain the latest exploit free version of the scripts. If a script that our web hosting clients uploads to our servers is found to have security lapses and allows a third party to “hack”, “exploit”, “deface” their site(s) it is the responsibility of our clients to either remove that script or MyGreenEcoHosting.com reserves the right to terminate that clients’ account and provide them with a prorated refund.
FALSE INFORMATION
Customer agrees not to post false or inaccurate information to news groups in violation of the news groups rules and regulations. If any news groups or service provider contact MyGreenEcoHosting.com concerning unethical, false or unlawful activities by you, MyGreenEcoHosting.com reserve the right to suspend or terminate your service with or without notice.
LICENSED SOFTWARE ONLY
Client agrees to use only properly licensed third party software in connection with Client’s use of the Services.
BACK-UP FILES
MyGreenEcoHosting.com provides the tools needed to create back ups of account data. MyGreenEcoHosting.com also backs up its servers and retains a copy for 24 hours for disaster recovery purposes only. It is the responsibility of the customer to keep up-to-date archives of their backed up data. MyGreenEcoHosting.com does not provide or keep records or copies of our clients web site files for customer use and is not responsible for any loss of data including but not limited to hardware failure, backup failure, hacking or accidental deletion.
ACCOUNT ACTIVATION
By activating your account with MyGreenEcoHosting.com, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.
NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.
SERVER UPTIME GUARANTEE
MyGreenEcoHosting.com guarantees 99.9% service (http, ftp, pop, imap, smtp) uptime on all hosting plans. Should we fail to deliver this for any given calendar month, your account will be refunded a pro-rated amount for the duration of excessive downtime.
MyGreenEcoHosting.com reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
